These Regulations provide for the conduct of children’s homes. They supersede the existing Regulations relating to voluntary children’s homes, and provide that all types of children’s homes, whether homes provided under Part VII of the Children (Northern Ireland) Order 1995, voluntary homes or registered children’s homes are subject to the same or similar provisions.

These Regulations are made under the Health and Personal Social Services (Quality, Improvement and Regulation) (Northern Ireland) Order 2003 (“the Order”). Part II of the Order establishes, the Northern Ireland Health and Personal Social Services Regulation and Improvement Authority (“the Regulation and Improvement Authority”) and Part III provides for the registration and inspection of establishments and agencies, including children’s homes, by the Regulation and Improvement Authority. It also provides powers for regulations governing the conduct of establishments and agencies. The majority of Parts II and III of the Order (in so far as not already in operation) will be brought into operation on 1st April 2005.

These Regulations provide for amendments to the Foster Placement (Children) Regulations (Northern Ireland) 1996. Regulation 2(1) amends regulation 11(3) of the Foster Placement (Children) Regulations (Northern Ireland) 1996 by extending the period to complete an initial assessment of a person with whom a child is placed in an emergency situation. The amendment extends the period from 6 weeks to 12 weeks. The purpose of the change is to allow a more realistic timescale for the completion of the initial assessment of a potential carer, which includes an evaluation of the proposed accommodation, access to medical reports, obtaining references and undertaking AccessNI enhanced disclosure checks.

These Regulations replace the Children and Young Persons (Boarding-Out) Regulations (Northern

Ireland) 1976. The Regulations apply to placements of children by authorities and voluntary organisations, other

than placements to which the Placement of Children with Parents etc. Regulations (Northern Ireland)

1996 apply and placements for adoption or with a person having parental responsibility for a child

(regulation 2).
